The First of Baxter’s Jury Verdicts: A School Bus Driver Verdict

Melissa Baxter obtained a $133,121.00 jury verdict in Camden, County when an SUV in traffic struck a 39-year-old driver of a school bus. The defense maintained that the impact was light. Moreover, they also maintained that all of the injuries were pre-existing. However, at trial, Melissa dismantled the defense. She caught the defendant lying on the stand. And, she successfully utilized the testimony of the defendants’ own expert witness to support the case. Using technology to her client’s advantage, Melissa also created a PowerPoint presentation to prove the case. Additionally, she obtained a verdict that was over $50,000 more than the offer to settle.

A Single Mother Verdict

That win came at the heels of a $115,000.00 verdict Melissa won for a 27-year-old single mother. The mother sustained neck and back injuries; a commercial pickup truck at a red light in Atlantic City, New Jersey, rear-ended her in her minivan. In that case, whose venue was also in Camden County, the defense refuted the extent of the injuries. But, the defense could not overcome the evidence Melissa introduced at trial. This includes the testimony of an orthopedic expert and a treating chiropractor to prove that all of the injuries were directly related to the crash. And, to highlight the severity and life-long impact of the injuries.

Pediatric Critical Care Nurse Verdict

Most recently Melissa obtained a $62,581.98 jury verdict in Camden County for a 52-year-old pediatric critical care nurse. The nurse sustained significant low back injuries which required injections and a rhizotomy. This happened when an uninsured driver struck her while stopping in traffic. The case was litigated against Liberty Mutual who provided uninsured motorists coverage. Moreover, they argued that the injuries were due to aging. At trial, Melissa called the treating physician, the family doctor, and family members to the stand to testify to prove that all of the injuries were related to the crash. By utilizing the NJ Court Rules to her client’s advantage, Melissa was also awarded trial costs and attorneys’ fees because the verdict was more than 120% above the settlement offer.
